Terms of Service

1. Service description
Milepost Dispatch (operated by NSAWA Enterprises LLC) provides truck dispatch services for owner-operators and small motor carriers. Our services include load searching, rate negotiation, broker communication, paperwork coordination, and related logistics support.
2. Carrier responsibilities
- You must hold a valid, active MC number and USDOT authority
- You must maintain insurance at required minimum levels ($1M auto liability, $100K cargo)
- You are responsible for all aspects of load execution — pickup, delivery, cargo security, compliance with DOT regulations
- You are responsible for all fuel, maintenance, and operating costs
- You agree to accept or refuse loads at your sole discretion; Milepost Dispatch does not guarantee load volume
3. Commission and payment
You agree to pay Milepost Dispatch a commission on loads dispatched, as specified in your service agreement. Commission is charged on the gross load amount (including fuel surcharge). Payment terms are weekly via ACH, debit, or check.
Milepost Dispatch does not collect payment directly from brokers. You remain solely responsible for invoice collection.
4. Relationship of parties
You are an independent contractor, not an employee. Milepost Dispatch is a dispatch service provider, not a motor carrier or broker. We act as your agent in load negotiations. We are not responsible for shipper or broker non-payment, cargo damage claims, or accidents.
5. Limitation of liability
Milepost Dispatch's liability is limited to fees paid in the 30 days preceding any claim. We are not liable for lost revenue, cargo damage, broker fraud, regulatory fines, or any indirect damages arising from dispatch services.
6. Termination
Either party may terminate service with 7 days written notice. You remain responsible for commission on all loads booked prior to termination. Milepost Dispatch may terminate immediately for non-payment or misrepresentation of credentials.
7. Governing law
These terms are governed by the laws of the state of [State], United States. Disputes shall be resolved by binding arbitration.
